Summary The claimant made two complaints alleging that the Union had 1) breached section 30(2)(a) of the 1992 Act by not allowing access to the Unions accounting records within 28 days of the request being made and 2) breached section 30(6) of the 1992 Act by demanding an amount which exceeded the reasonable administrative expenses incurred by the union in respect of the accounts requested. The first complaint was upheld by the Certification Officer and an enforcement order was issued. The Certification Officer dismissed the second complaint.

Summary The Claimant alleged that UCATT had breached section 30 of the 1992 Act by failing to comply with his request for access to certain accounting records of the union within 28 days of his request. The claimant had in particular sought access to accounting records relating to the expenses paid to members of the union’s Executive Council and General Secretary. At the hearing the union and the complainant reached an agreement on providing access to the requested accounting records. The application was dismissed upon withdrawal by the Claimant.

Summary The four Claimants made a total of seven complaints alleging breach of sections 30(2)(a), 47(2) and 49(2)(b) of the 1992 Act and breach of union rules. The complaint by Ms Haynes related to access to accounting records and was dismissed by the Certification Officer upon its withdrawal. The other complaints from Messrs Potter, Mullen and McLinden alleged breaches of statute and union rule relating to the elections to the National Executive, the appointment and removal of officers and posts and the calling of a special general meeting. The Certification Officer dismissed all the complaints.

Summary Complaints were made that the union had breached section 30 of the 1992 Act by failing to provide the claimants with access to the accounting records of their branch and that the union had acted in breach of its rules in respect of a branch's failure to elect members to two committees (section 108A(2)(a) of the 1992 Act). It was found that the union had failed to comply with the claimant's request for access to the branch accounting records and an enforcement order was made. The complaints of alleged breaches of union rule were dismissed.
